   <description><![CDATA[<span style="font-size: 40px;"><span style="color: red"><strong>BMI to Sue Pandora</strong></span></span><br /><br /><img class="imgcode" src="http://images.radcity.net/5173/4319610.gif" alt="" /><br /><br /><a href="http://www.radioink.com" title="www.radioink.com" onclick="target='_new';"><img class="imgcode" src="http://www.radioink.com/images/Topframe_left.gif" alt="" /></a><br />&nbsp;&nbsp; June 13th, 2013<br /><br /><span style="font-size: 17px;">The battle between Pandora and music publishers such as ASCAP and BMI just got a little more interesting and, for sure, will be heading to court. BMI has ended negotiations with Pandora and filed a lawsuit against the online music service (<a href="http://www.radioink.com/goout.asp?u=http://radioinkmedia.intertechmedia.com/bmilawsuit.pdf" title="www.radioink.com/goout.asp?u=http://radioinkmedia.intertechmedia.com/bmilawsuit.pdf" onclick="target='_new';">READ IT HERE</a>). BMI also issued the following statement:</span><br /><br /><span style="font-size: 14px;">Broadcast Music Inc (BMI) filed an action in New York City today asking the Federal Rate Court to set royalty fees for internet radio service Pandora on behalf of the organization's 600,000 songwriters, composers and music publishers. The action asks the court to set reasonable, market driven fees for Pandora after negotiations did not result in an agreement.&nbsp;&nbsp;BMI represents the public performance copyright interest of its affiliates when their works are played across all venues including the internet, cable, broadcast television and radio, satellite and in nightclubs, bars and other commercial establishments. BMI negotiated the first music industry blanket copyright license agreement for the performance of music online in 1995.&nbsp;&nbsp; Today, there are approximately 10,000 digital properties covered by BMI licenses.&nbsp;&nbsp;This is the first time the organization has resorted to litigation on fees in the digital arena in the 18 years since it signed the first music industry copyright license for the performance of music on the internet.<br /><br />Pandora responded to the action with the following statement just sent to Radio Ink:<br />“Disputes regarding the reasonableness of fees between BMI and music users are adjudicated in Federal court just as disputes between ASCAP and music users. This process is required by the consent decrees both organizations agreed to after the U.S. Department of Justice sued them for anti-competitive behavior. Utilising &quot;all music sales, merchandise, touring revenue, licensing, endorsements, real estate, royalties and more,&quot; as their barometers of worth, and by obtaining said information from &quot;all publicly available sources, promoters, managers, club owners and, in some cases, the artists themselves,&quot; the list, unsurprisingly, is full of purveyors of the American led EDM sound as well as the usual suspects that usually place highly in the annual 'top DJ' lists of DJ Mag and Mixmag - the global trance, electro and superstar DJ brigade</span>.<br /><br /><span style="font-size: 14px;">Topping the list is the ubiquitous Tiesto, the big room, stadium ready Trance stalwart, that seemingly does nothing else other than DJ to huge crowds of 'off-ya-face' youngsters and elders alike. With presumed earnings of $75 million dollars, Tiesto earns more in a year than pretty much any Hollywood A-List actor. The Forbes Rich List of 2012 put Tom Cruise at the top of that illustrious list, earning the same as Tiesto, a cool and breezy $74 million. Second to Cruise came Leonardo Di Caprio and Adam Sandler, both reputed to have earned about $37 million, absolute pittance compared to the top 10 ranking DJ's according to celebrityworth.net's list.<br /><br />Second and third on the DJ Rich-list reside Daft Punkers Guy and Thomas, with their ridiculous $60 million earned this SO FAR this year (their album has only just come out as well), closely followed by Paul Oakenfold at $58 million. It's absolutely crazy money these people earn, but interesting to see.<br /><br />Special mention has to go out to superstar, reality DJ 'Pauly D' who on top of his lucrative line of tanning products somehow managed to scoop an extra $6 million odd by pressing play and pumping his fist in the air a lot. God bless you, buddy!” said McGraw, one of several Hollywood notables who attended, along with Natalie Cole, Stevie Wonder, Baby Face, Kenny G, Carole Bayer Sager and producer George Schlatter.<br /><br />Los Angeles Mayor Antonio Villaraigosa even made an appearance.<br /><br />“I get invited [to star unveilings] virtually every time,” he said at the event organized by the Hollywood Chamber of Commerce. “I hardly ever come, but I had to be here to honour David Foster, a great friend and one of the most talented people I know.”<br /><br />Cole, whose musical collaborations with Foster include Unforgettable and a new Spanish-language album of Latin standards recorded by her father, Nat King Cole, said she was thrilled her star was in the same area as Foster’s.<br /><br /> His star is also next to Buddy Holly’s and those dedicated to his musical heroes, The Beatles.<br /><br />“I’ve learned so much from you. I respect you so much. I love you so much,” Cole told Foster. “David is tough and he doesn’t want to do anything he’s going to fail at. This is so long overdue. Congratulations.”<br /><br />The singer, songwriter, composer, arranger and producer said he was “overwhelmed” at joining such legendary company 40 years after he launched his career when Capitol signed his band Skylark.<br /><br />He even sang a few bars from Wildflower, Skylark’s 1972 Top-10 hit, before reflecting on his career and personal life. He also yelled “Steve, you made it!” when Wonder showed up despite being in the studio until 5 o’clock that morning.<br /><br />“The entire world knows Hollywood is a place where dreams come true and today, you certainly made mine come true,” said Foster, who also thanked industry associates, his family, Victoria’s Chris Earthy (“My oldest friend”) and the Victoria-based David Foster Foundation board members he flew to L.A. to help celebrate Hollywood’s David Foster Day.<br /><br /> Board member Levi Sampson praised Foster — now the chairman of Universal’s Verve Music Group — for using the occasion to shine the spotlight on his foundation, which aids families of children who need organ transplants. He had been battling bile duct cancer. Manzarek was 74.<br /><br />The keyboardist, whose snaky Vox organ solos were as much a part of The Doors’ sound as Jim Morrison’s Beat poet vocals, Robbie Krieger’s psychedelic blues guitar and John Densmore’s jazzy drum work, met Morrison while they both attended UCLA’s film school in the early ‘60s.<br /> <br />Born Feb. 12, 1939, in Chicago, Manzarek graduated from DePaul before making his pivotal move to California. Shortly after they both graduated from UCLA, Manzarek and Morrison ran into each other on Venice Beach. After hearing Morrison sing “Moonlight Drive” for him, they decided to form The Doors, named after Aldous Huxley’s 1954 groundbreaking drug book, The Doors of Perception. Krieger and Densmore joined the band after meeting Manzarek at a transcendental meditation lecture.<br /> <br />The Doors initially signed to Columbia, but then Elektra picked them up when Columbia inexplicably dropped the fledgling band. Released in 1967, The Doors eponymous debut album literally broke on through to the other side, hitting No. 2 on the charts, led by “Light My Fire,” the band’s first No. 1 song. The seven-minute album version (written by Krieger) may have been sliced to three for the single, but it still retained its sonic power, anchored by Manzarek's and Krieger’s lengthy solos.<br /> <br />The band would record five more stellar albums before Morrison’s mysterious death in Paris in 1971.<br /> <br />During the post-Doors years, Manzarek recorded several solo albums and wrote three books, one of which (Light My Fire: My Life with The Doors) told his version of the epochal five-year stretch when The Doors were one of the greatest bands of the classic-rock era.<br /> <br />Manzarek and Krieger got back together in 2001 and formed The Doors of the 21st Century, featuring The Cult’s Ian Astbury on vocals. But Densmore, who disapproved of their appropriation of The Doors name, sued and was able to shut down the tour. Manzarek and Krieger subsequently toured together under their own names, playing The Doors music people wanted to hear. Now Krieger will have to go it alone.<br /> <br />“I'm just glad to have been able to have played Doors songs with him for the last decade,” the guitarist said in a press release posted at Facebook. “Ray was a huge part of my life.”<br /> <br />Manzarek is survived by his wife Dorothy, who he also met at UCLA, brothers Rick and James Manczarek, son Pablo Manzarek, Pablo's wife Sharmin and their three children Noah, Apollo and Camille. The Manzarek family asks that, in lieu of flowers, donations can be made in Ray Manzarek's name at <a href="http://www.standup2cancer.org">http://www.standup2cancer.org</a>. Funeral arrangements are pending.<br /> <br />In Manzarek's honor, Sunset Strip staples The Roxy and Whisky A Go Go are displaying remembrances on their respective marquees. The former reads: &quot;We love you Ray Manzarek. She went to police in 2009 and Bachman was charged in 2010.<br /> <br />A ban on publication was imposed in 2010 on Bachman's name to shield the identity of the complainant.<br /> <br />But the bans on both Bachman and Bohun were lifted last month by Justice Neill Brown after an application by a reporter with The Canadian Press and with the approval of Bohun.</span><br /><br /><br /><a href="http://www.cbc.ca/news/canada/british-columbia/story/2013/05/01/bc-tim-bachman-sex-charges.html">http://www.cbc.ca/news/canada/british-columbia/story/2013/05/01/bc-tim-bachman-sex-charges.html</a>]]></description>
