VANCOUVER — Robbie Bachman is suing his older brother, Randy Bachman, and another former member of the 1970s rock group Bachman-Turner Overdrive for using the BTO name without permission.
The lawsuit by former BTO members Blair Thornton and Robin (Robbie) Bachman is seeking damages and a permanent injunction against Randy Bachman and former band mate Charles (Fred) Turner to restrain them from using the BTO name in any new live performances or audio and video recordings without the written consent of the plaintiffs.
Thornton and Robbie Bachman, the 56-year-old former drummer for BTO who lives in Surrey, B.C., claim that when Randy Bachman left BTO in 1977 to pursue a solo career, there was an agreement that he would not use the BTO name in any new recordings.
The legal action claims that after a series of written and oral agreements since 1984, the rights to the band's name were assigned to the plaintiffs, but Randy Bachman and Turner profited by forming a group using one or more names similar to Bachman-Turner Overdrive, thereby directly competing with the plaintiffs.
The lawsuit was filed in B.C. Supreme Court in Vancouver on behalf of the plaintiffs by lawyer Michael Katzalay of the Lang Michener law firm.
Randy Bachman, 66, originally a guitarist with Chad Allan and the Silvertones, scored his first number 1 hit in 1965 with the legendary Winnipeg band, The Guess Who.
He formed Brave Belt in 1970, which changed its name two years later to Bachman-Turner Overdrive, which produced such hits as Let it Ride, Roll on Down the Highway, Takin' Care of Business and You Ain't Seen Nothin' Yet.

I was thinking it was weird that BTO and the Guess Who are active touring bands but without Randy. I can see how it happened but it must bug him to no end. And I'm not sure who would pay good money to see what is pretty much a cover band.

Geeze, whatever happened to picking up the phone and TALKING to your own brother??? Sad when family members have to speak through lawyers. You KNOW who's going to end up with the money..........

Wasn't the band called Chad Allan and the Expressions? The One International hit was 'Shakin All Over' 1965. I was a regular listener of Seattle's KOL 1300am and remember disc jockey Ray Ramsey (later to become a KOMO TV weatherman) announcing this group from a place called Winnipeg in Canada. It was a proud moment for this Canadian :)

They were called Chad Allan & The Silvertones for a while,before changing to The Expressions.
I went to the same school as Jim Kale & Bob Ashley. Here is brief history of the bands name in the early 60's
